T3CP Disclaimer

Softwarelizenzvertrag & Haftungsausschluss
Zwischen Ihnen bzw. der Person die das T3CP Programm lädt, im folgenden NUTZER genannt und der C. Gathmann Computer-System-Beratung GmbH, Wachtstr. 17, 28195 Bremen, Deutschland im folgenden CSBG genannt, wird folgender Vertrag geschlossen:
CSBG erteilt dem NUTZER eine freibleibende, unverbindliche Lizenz zur Benutzung des T3CP-Programms in der jeweils vorhandenen Version. Der NUTZER erhält von CSBG eine nicht exklusive, gegebenenfalls zeitlich befristete, unübertragbare und widerrufliche Lizenz, die Software zu nutzen. Das Urheberrecht und Eigentumsrecht an der Software bleibt bei CSBG.

Der NUTZER erhält von CSBG eine Beratungsleistung nur wenn er sie besonders wünscht und gesondert beauftragt. CSBG ist zu keiner weiteren Leistung verpflichtet.
CSBG stellt dem NUTZER eine Dokumentation online aufrufbar im T3CP-Programm zur Verfügung.
Durch die für den NUTZER optionale Registrierung können weitere Programm-Funktionen auch im Test-Modus freigeschaltet werden. Dafür erhält der NUTZER einen persönlichen Lizenz-Schlüssel (LK). Bei Kauf einer entsprechenden T3CP-Lizenz erhalten Sie den produktiven LK.
Der NUTZER verpflichtet sich, Dritten keinen Zugang zu seinem persönlichen Lizenz-Schlüssel zu gewähren bzw. diesen nicht weiter zugeben.

CSBG hat die Software mit größter Sorgfalt erstellt und stellt sie so wie sie ist dem NUTZER zur Verfügung. CSBG garantiert keine Fehlerfreiheit, schließt jegliche Haftung und Gewährleistungsansprüche aus, die gesetzlich ausgeschlossen werden können und hat keine Verpflichtung Fehler zu beheben. Aus diesem Vertag entstehen keinerlei Rechtsansprüche gegen CSBG. CSBG übernimmt keine Haftung für Schäden jeglicher Art, auch nicht die, die sich aus der Verwendung der Software ergeben.
Der NUTZER darf an der Software keinerlei Änderungen vornehmen.
Das Urheberrecht für diese Software verbleibt bei CSBG.
Der NUTZER haftet gegenüber CSBG für alle Schäden, die aus einer Nichteinhaltung dieses Vertrages CSBG entstehen, eine Haftungsbeschränkung diesbezüglich gilt nicht soweit diese gesetzlich zulässig ist.
Im Fall dass Teile dieses Vertrages oder der gesamte Vertrag unwirksam oder nicht möglich sind, oder zukünftig werden, bleibt die Wirksamkeit dieses Vertrages im Übrigen bestehen. Anstelle  von unwirksamer oder unmöglicher Bestimmung soll diejenige wirksame und durchführbare Bestimmung treten, deren Wirkungen die Zielsetzung dieses Vertrages möglichst nahe kommen. Gleiches gilt wenn der Vertrag Lücken aufweist.
Für diesen Vertrag gilt ausschließlich deutsches Recht. Gerichtsstand für alle Angelegenheiten aus diesem Vertrag ist Bremen.

Software License Agreement & Disclaimer
Between you or the downloader and user loading the T3CP application, hereinafter called the USER and the C. Gathmann Computer-System-Beratung GmbH, Wachtstr. 17, 28195 Bremen, Germany hereinafter called CSBG, the following contract is concluded:
CSBG grants the USER a remaining free, no-obligation license to use the software T3CP in each existing version. The USER receives from CSBG a non-exclusive, possibly temporary, non-transferable, revocable license to use the T3CP application. The copyright and ownership of the software remains with CSBG.
The USER receives from CSBG additional service only on request and by separate order. CSBG is not obligated to any further extra service.
CSBG grants the USER a documentary available online within the application T3CP
Further functionality can be activated by registration, which is optional for the USER in the test phase. The USER will receive a personal license key (LK) for the test phase, and another one after purchase of license for the T3CP application. The USER will not admit access to his LK to any third party and ensure that nobody has access to his personal license key.
CSBG created the software with it utmost care. CSBG does not guarantee the accuracy, excludes all liability and warranties that may be excluded by law and has no obligation to fix bugs. This agreement does not create any legal claims against CSBG. CSBG does not assume any liability for damages of any kind including those that result from the use of the software.
The USER must not make any changes to the software.
The copyright for this software remains with CSBG.
The USER shall be liable to CSBG for all damages resulting from a failure to comply with this contract to CSBG; a limitation of liability in this respect does not apply where this is permitted by law.
In case parts of this contract or the entire contract are ineffective or not possible, or become so in the future, the validity of this agreement will remain in the other respects. Instead of ineffective or impossible provision shall be replaced, the effects of which come as close as possible the objectives of this agreement by such valid and enforceable provision. The same applies if the contract has gaps
Exclusively German law applies to this contract. Jurisdiction for all matters arising from this contract is Bremen.
